Diversion..

would someone mind explaing to me how this works?
as i have just found myself in a predicament is wich im told i can get this??

if what you're up for is quite small- the court might decide it's not worth wasting too much time over- also it considers that it would not be fair for you to have a 'conviction' of any sort on an otherwise clean record because of some monor mis d- so- if you ask to be processed under diversions you don't get a conviction- you do have to pay minimal court costs (under $100)- & it serves as a handsmacking- if- however- you are up for something you didn't do- plead not guilty & go for it-

Typicall diversion also involes either a fine or community service.

does diversion pay for damaged govt stuff?:s

diversions apply for something as minor as possessing a joint or 2, all youll get is probably 10 hours of mowing old ladys lawns, picking up rubbish on the riverbanks or paying $25 to the NZ Blind foundation.

personally its a waste of time arresting even searching somebody possessing a small amount of dak for there own use.

Diversion is actually a scheme administered by the police - they agree to withdraw charges upon the accused agreeing to do something good, something like making a donation to an agreed cause. Its pretty informal, there is no court sentence involved, so PD isn't an option (although the accused might agree to doing a certain amount of charity work). Its good for keeping one-off, out-of-character minor offences off the books (although the Police do have a record of the diversion) - so if the offence is small time drug related, minor assault, theft etc then there is a good chance that diversion is an option. The decision is normally made by the Police prosecutor, rather than the arresting officer, which can help reduce difficulties arising from personality conflicts.
