inspired by the guy who hacked the resever bank and then billed them and then got discharged, the police officer on trrial for making threat against the PM and whiterhino's reference to JC's misleadership. i'm interested in if anyone can give information regarding defamation cases, and the specifics of this legislation iwith regard to puns, double definitions and spelling mistakes, misleading wording etc ,

Firstly: I am not a legal expert, but not being an expert has never before stopped me from speaking very loudly! ;)
Secondly: The Defamation Act of 1992 (http://www.legislation.govt.nz/browse_vw.asp?content-set=pal_statutes) does not have any direct provisions about "puns, double definitions and spelling mistakes, misleading wording". It does say things like, "It is not necessary to allege or prove special damage" (Section 4), "A defence of truth shall succeed if... the defendant proves that the imputations ... were true" (Section 5), and "In any proceedings for defamation in respect of matter that includes or consists of an... opinion, a defence of honest opinion... shall fail unless the defendant proves that the opinion expressed was the defendant's genuine opinion" (Section 10).

I'd estimate that the decision about whether or not something is defamatory rests not on form (puns, double definitions and spelling mistakes, misleading wording) but on whether or not it is generally understandable as being defamatory.

My what now? I don't deny it, it's just that there've been so many instances where I've told JC to go fuck himself in a wide range of ways that I'm not sure which time you're referring to.
